Nest Home Care Privacy Policy

Nest Home Care ("Nest", "we", "us", "our") is dedicated to safeguarding the privacy, confidentiality, and security of personal and health information of our clients, prospective clients, and website visitors. This policy explains how we collect, use, disclose, and protect your information in compliance with the BC Freedom of Information and Protection of Privacy Act (FIPPA), Personal Information Protection Act (PIPA), and, where applicable, Ontario’s Personal Health Information Protection Act (PHIPA).
1. Accountability
Nest Home Care is accountable for all personal and health information in our custody, including information provided to third parties for administrative, operational, or care purposes.

2. Collection of Personal and Health Information
We collect only the information necessary to provide home and community care services, fulfill legal and contractual obligations, and improve our service and website.
Types of information we may collect:
Contact: Name, address, telephone number, email
Health: Birth date, gender, Personal Health Number, medical history, diagnoses, care/treatment records, emergency contacts, and care preferences
Technical: When you visit our website, information such as your IP address, browser type, pages accessed, and cookies is collected.
Application or inquiry details (for job applicants, contractors, or general inquiries)
3. Consent
We rely on express or implied consent to collect, use, and disclose personal and health information. By seeking, accepting, or continuing care with Nest, or by using our website, you consent to the collection, use, and sharing of your information as described, subject to any applicable legal exceptions.
You may withdraw consent at any time, subject to legal or regulatory limitations, by contacting our Privacy Officer.

Deliver requested home care, health, and support services
Assess service eligibility and develop care plans
Communicate with you, your caregivers, or legal representatives
Bill for services and meet regulatory requirements

Your information will not be used for purposes not identified at the time of collection except with your further consent or as required by law.
5. Disclosure of Information
We may share your information under certain circumstances, including:
With your consent, within your “circle of care” (authorized family, caregivers, healthcare providers, insurers)
With partner agencies, contractors, or service providers, all bound by confidentiality obligations
As required or permitted by law, including emergencies, abuse reporting, or regulatory investigations
Cross-jurisdictional transfers (e.g., to/from Ontario) will comply with both FIPPA (BC) and, where applicable, PHIPA (Ontario), ensuring data is handled by both statutes
We never sell or rent your personal or health information.
6. Safeguarding Information
Nest Home Care maintains appropriate administrative, technical, and physical safeguards:
Secure physical and electronic records
Limited access to staff and contractors on a need-to-know basis
Strong passwords, encryption, and locked storage
Staff and contractors receive privacy training and are required to adhere to this policy.
7. Access and Correction
Under FIPPA (BC), PIPA (BC), and PHIPA (Ontario), you have the right to request access to, or correction of, your personal or health information in our care. Requests can be made in writing to our Privacy Officer and will be responded to within the time limits of applicable legislation.
8. Retention and Disposal
We retain information only as long as necessary for the purposes for which it was collected, for legal/regulatory compliance, or as required for business continuity. Secure destruction processes are used for the disposal of paper and electronic records.
9. Cookies and Website Analytics
Our website may use cookies and similar technologies to analyze site usage, improve security, and enhance your experience. You may control cookies via your browser settings.
10. Children’s Privacy
We do not knowingly collect personal information from children under the age of 13 without verifiable parental or guardian consent.
